CONCEPTUAL APPROACHES TO THE PREVENTION OF TORTURE AND OTHER CRUEL, INHUMAN OR DEGRADING TREATMENT OR PUNISHMENT IN GEORGIA

Abstract

The article is devoted to the problem of the prevention of torture and other cruel, inhuman or degrading treatment or punishment in Georgia. In particular, the article discusses the problems in this area, to which the author includes: the torture of the accused during the investigation, the use of evidence obtained through torture, poor prison conditions and overcrowding of closed institutions, the lack of an effective investigation into the mechanisms of information about torture, the use of force in prisons. The paper proposes measures on prevention of violence in law enforcement, which includes: changes in the principles of the law enforcement agencies and the creation of an ideological level atmosphere of intolerance towards the use of torture, and new approaches to the selection and evaluation of personnel in law enforcement, guarantees of the rights of detainees, to create an atmosphere of intolerance, acts of torture, changes in the judicial system principles of work, reform in prisons, coordinating the work
