In this article, the author attempts to study certain relevant aspects of legal regulation of crowdfunding relations and identifies the main trends and prospects for their development in the Republic of Kazakhstan. The scientific conclusions are based on the analysis of the norms of legislation of foreign countries and the current world practice of using alternative non-Bank methods of financing promising projects in various areas of society's life, including in the field of civil turnover.
Active integration of the Republic of Kazakhstan into the international economic space and rapidly developing internal processes require improving the mechanisms of legal regulation of objectively emerging relations of a completely new type, including crowdfunding relations that have great potential for effective growth and development of civil turnover. Our state will have to change significantly in order to become able to meet the modern principles and standards of interaction between market members, which are imposed by the international community of the civil and legal side of society's life.
Today, in Kazakhstan, the process of forming the regulatory framework for crowdfunding is associated with solving an important range of tasks related to the development of an adequate system of relevant legal norms, overcoming possible gaps and conflicts in legislation regulating related relations, and developing an effective mechanism for protecting the rights of subjects of crowdfunding relations. As soon as possible, their resolution is ultimately aimed at creating an effective system that allows you to regulate crowdfunding relations in civil law using the most civilized methods borrowed from the best world experience.
The author of the article within this context explores some current problems of the phenomenon of crowdfunding, and also makes suggestions on creating a legal framework for regulating crowdfunding relations.
