THE INTERNATIONAL LEGAL PROTECTION OF FAMILY RIGHTS IN THE PERIOD OF ARMED CONFLICTS AND INTERNAL TENSIONS

Through family relations, the essential interests of humans and society is realizing. The traditions of the Central Asian people based on the family values, that is why the problems between societies in the form of military conflicts and internal tension have a negative impact on both the future life of people and the future living conditions of the younger generation. This research emphasizes the fact that the institution of the family is protected by the legal norms of national and international legislation during peacetime, while the timing of armed conflicts and domestic violence the family rights protection becomes one of the most vulnerable issue. The main goal of the work is to study international norms of the family rights protection in time of armed conflict, as well as a detailed analysis of the national legislation of the Kyrgyz Republic protected such rights during period of internal tensions. The author analyzes the following issues: 1) the main violations of family rights during internal tension and armed conflicts, 2) the legal basis for the protection and protection of family rights during armed conflicts and situations of internal tension according to the Kyrgyzstani legislation, and 3) the role of the International Red Cross and Red Crescent Movement in protecting family rights in the Kyrgyz Republic (for instance, the case of tension in the South of Kyrgyzstan in 2010). It is noted that despite the rather effective legal mechanism for the family rights protection in the Kyrgyz Republic, there are problems in this issue in the country. Proceeding from the generalized analysis of the regulatory and legal framework of the Kyrgyz Republic, existing theoretical views and expressed author's comments, a conceptual approach to the definition of an institution for the protection of family rights during armed conflicts and situations of internal tension and recommendations are proposed.
