Abstract

The collapse of the Soviet Union was the largest geopolitical event of the 20th century. The subsequent formation and development of independent states, including the Republic of Kazakhstan, formed on the ruins of the Soviet empire, redrawn the political map on the vast Eurasian continent.

In the formation of a new state, the definition of its main direction and essence of development, as well as the structural and functional organization of the system of power, comes to the fore. The most important and first political and constitutional act that determined the basis of the state and social system was the «Declaration on the State Sovereignty of the Kazakh SSR». Adopted by the Supreme Council of the Republic on October 25, 1990, it laid the legislative basis for the development of an independent, self-sufficient Kazakh national statehood.

 The Kazakh SSR declared its sovereignty, the penultimate of the union republics. After Kazakhstan, Kyrgyzstan adopted such a declaration. The political process of the early 1990s, called the «parade of sovereignties», ended a year later with the collapse of the USSR.

On December 16, 1991, the Supreme Council of the Republic of Kazakhstan adopted the constitutional law «On the State Independence of the Republic of Kazakhstan».

This year we celebrate the 30th anniversary of the Independence of the Republic of Kazakhstan and, as part of the celebration of this glorious anniversary, a lot of work is being done throughout the country to promote national ideology and educate Kazakhstani patriotism, popularize and disseminate the historical and cultural heritage of the people of Kazakhstan, including information about the recent history of our state.

At the same time, the authors of the study come to the conclusion that the contradiction between the constitutional law «On the state independence of the Republic of Kazakhstan» and the main law of the country leveled the legal nature of the Declaration of State Sovereignty.
