FORMATION OF LEGAL PARADIGM OF THE INDEPENDENCE OF THE REPUBLIC OF KAZAKHSTAN

Abstract

The legal paradigm in legal science phenomenon relatively new and needs further validation and application to its institutions and legal matter as a whole.

Kazakhstan's independence is as a political and legal category comes into view in relation to the historical objectivity.

The need for consideration of independence from the perspective of the legal paradigm occupies the minds of society and state institutions and the needs not only direction, but also the formation and development further.

In our opinion, Kazakhstan gained independence, has not yet received adequate legal development and interpretation of the general constitutional promise arising from the Preamble of the Constitution, which may cause lack of legal provision for securing institutional perception of this landmark event for the people of Kazakhstan and the world community.

Under the legal paradigm can be understood as conceptual objective the installation produced in the state and society on all areas of their life, aimed at the establishment and development of independent Kazakhstan with the inclusion of a legal matter.

It is necessary to draw a conclusion about the necessity of further development of the legal paradigm of the most important and fundamental basis of sovereign Kazakhstan, with the inclusion and generalization of scientific and theoretical development, expansion and deepening of the ideological platform for their explanation and advocacy as a matter of domestic and foreign policy.

This article is dedicated to the problem of setting the content of the legal paradigm as a system of views on independence, the origins of the legal framework and basic (fundamental) and a systematic approach to the rationale of objectivity epochal event.
