THE LEGAL BASIS FOR THE CREATION OF THE EURASIAN ECONOMIC UNION

The article describes the historical aspects of the formation and the establishment of the Eurasian integration - from the Eurasian idea of the President of the Republic of Kazakhstan Nursultan Nazarbayev to the establishment and functioning of the Eurasian Economic Union.
The author attempts to analyze the legal and institutional framework for the establishment and functioning of the Eurasian integration, taking into account the importance of the Commonwealth of Independent States and the Eurasian Economic Community in the development of integration processes in the Eurasian space.
This article describes the four stages of the Eurasian integration interaction: 1) creation of a Free Trade Zone;
2) the establishment of the Customs Union (a single customs territory, the common customs tariff, the abolition of customs controls at the internal customs borders, etc.).;3) formation of the Common Economic Space (functioning of the common (internal) market for goods, services, capital and labor, pursuing a coordinated tax, monetary, currency and financial, trade, customs and tariff policy, development of unified transport, energy and information systems, conduct general economic policy and the creation of common infrastructure);
4) establishment of the Eurasian Economic Union (the international organization of regional economic integration, which has international legal personality.
Each stage is characterized by certain features, degree of integration, to judge the depth of which can be concluded by international treaties (agreements) in the post-Soviet space.
