SOME PROBLEMS OF APPLICATION OF MEASURES IN CASES OF ADMINISTRATIVE OFFENCES IN THE FIELD OF ENVIRONMENTAL PROTECTION AND USE OF NATURAL RESOURCES

Ensuring environmental safety of the Republic of Kazakhstan is one of the main tasks of the authorized state bodies, including the bodies of internal Affairs. Kazakhstan's legislation gives the police an extensive list of powers to implement environmental and quarantine measures. In addition, the system of internal Affairs bodies is functioning environmental police units, whose primary task is to identify, prevent and suppress violations in the field of environmental protection and use of natural resources. The effectiveness of these units, in the first place, depends on the perfection of its legal and organizational basis. At the same time, the law gives these departments extensive powers to implement the mechanism of prevention and prevention of these offenses, including the procedure for bringing to administrative responsibility and the production of a number of procedural actions of a security nature, which are measures to ensure the proceedings on administrative offenses. The proper application of these measures depends both on the qualification of the environmental police themselves and on the appropriate legal regulation of their application, ensuring the feasibility and practical significance. At present, the environmental practice of the police is complicated by the imperfection of the legal regulation of the procedure for the participation of the defender in the proceedings on administrative offences, in particular, in the application of such measures to ensure the proceedings on administrative offences, as the delivery and withdrawal of tools for committing an administrative offense. The article analyzes the relevant articles of the Codes of the Republic of Kazakhstan on administrative offences of 2001 and 2014, as a result of which the author presents reasonable proposals to address the problems that have arisen in the practice of the environmental police.
