Abstract

The article is devoted to the issues of ensuring the authenticity of the law texts in Kazakh and Russian languages. The article analyzes the existing language shortcomings and gaps. An analysis was conducted to determine the correlation of terms in the texts of laws with the terms used in national legislation. As a result, such shortcomings as translation inconsistencies found in the texts of current legislation and non-compliance with the terminology sequence were identified.

Examples are given from the texts of current legislation that have inconsistencies in the translation of special and general terms, the ratio of industry and inter-industry terms, non-compliance with the terminological sequence, and other language shortcomings.

In the process of translation, incompatible translation inconsistencies often occur, which arise from the inability to understand the meaning of a word and distinguish between the content and scope of the concept. Thus, the phrase " irresistible force "is translated into Kazakh in different ways and is used: «бой бермейтін күш», «еңсерілмейтін күш», «еңсерілмес күш» «дүлей күш», «ырық бермес күш». In several variants, a person approved by the State terminology Commission and fixed in the current legislation should be used.

The author, having studied the texts of current legislation and makes the following conclusions: 1) it is necessary to develop special methodological manuals containing recommendations for the development of draft laws and registration of materials in the state language and methodological recommendations for conducting scientific linguistic expertise; 2) there is a need for normative approval of the list of academic grammars, normative dictionaries and reference books containing the norms of the modern Kazakh literary language; 3) also, draft legislative acts in the state language should be discussed by various specialists and conduct a comprehensive examination at all stages of legislative work.

If these prerequisites are met, the principle of ensuring the authenticity of texts in the Russian and Kazakh languages will be implemented, which in turn would be an indicator of the quality of national legislation.
