In pursuance of the Address of the Head of State K.K. Tokayev dated March 16, 2022 «New Kazakhstan: the path of renewal and modernization», the Law of the Republic of Kazakhstan «On Amendments and additions to the Constitution of the Republic of Kazakhstan» was adopted at the republican referendum, from that time the renewal of the legislative base in all areas of society and the state begins.
In the conditions of the active process of digitalization of social-labour relations, there is a need to guarantee that the subjects of social-labour relations observe the constitutional rights of citizens.
When analyzing the current labour legislation of the Republic of Kazakhstan for compliance with the political course of building a New Fair Kazakhstan, the need to consolidate the principle of «fair work» in the Labour Code of the Republic of Kazakhstan (next – LC RK) was established, the conclusions about the need for the state to provide certain guarantees for the implementation of fair relationships by subjects of social-labour relations are substantiated.
In this regard, the article considers some ways to modernize the labour legislation of the Republic of Kazakhstan by bringing it into line with the political course – «New Fair Kazakhstan». Based on the conducted research, a number of proposals have been prepared to consolidate the principle of labour fairness, improve the relationship of subjects of social-labour relations. The prepared proposals will increase and strengthen the level of people's confidence not only in state authorities, but also in employers and trade unions in the Republic of Kazakhstan.
The introduction of the principle of «fair work» into the system of labour legislation of the Republic of Kazakhstan will have a beneficial effect on the development of social-labour relations, since this novel will allow subjects to exercise moral self-control and fairly approach the performance of their duties, which, in turn, will strengthen the presumption of good faith, reasonableness and fairness on the part of participants in these legal relations.
