THE CONCEPT OF THE DRAFT LAW «ON PUBLIC CONTROL IN THE REPUBLIC OF KAZAKHSTAN» AND ISSUES OF INCREASING THE FORMS OF PUBLIC CONTROL

The article is devoted to topical issues of the implementation of public control in the Republic of Kazakhstan and its correlation with state control and public discussions. The authors considered the issues of the concept, principles, subjects of public control.
In this article, the author analyzes the theoretical issues of the impact of public control on the effectiveness of government agencies. Some issues of correlation between the mechanisms of public councils and public control are revealed. As part of the analysis, the Concept of the draft law and the draft Law of the Republic of Kazakhstan «On Public Control» and the accompanying «On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Public Control Issues» were considered. In conclusion, the authors concluded and made proposals for improving public control in the Republic of Kazakhstan.
The authors of the article believe that the main goal of public control is to suppress and prevent violations of rights and legitimate interests by public authorities. The interest of citizens in the management of state affairs is increasingly affecting the internal processes of the state, giving citizens the opportunity to manage and evaluate the activities of public authorities in order to increase the efficiency of their work. Public control is a prerequisite for the formation of civil society and the rule of law, and also acts as a guarantee for the implementation of legality and ensuring law and order in the country.
As a result of the study, the authors reveal the concept of «public control» by means of its correlation with other institutions of public control over the activities of state authorities: social and civil control. The authors come to the conclusion that the concepts of public and civil control are equivalent, define public control as a kind of social control, argue that it is one of the activities of public councils when the latter is understood as a means of protecting citizens' legitimate interests.
