RETURNING TO THE SCIENTIFIC PUBLICATION OF PHD M.ZH. KULIKPAEVA «INTERNATIONAL LEGAL FOUNDATIONS OF ENSURING THE RIGHT TO PRIVACY IN THE CONTEXT OF THE DEVELOPMENT OF DIGITAL TECHNOLOGIES»

Abstract

This article analyzes the article by M.Zh. Kulikpaeva "International legal framework for ensuring the right to privacy in the context of the development of digital technologies", which was published in the "Bulletin of the Institute of Legislation of the Republic of Kazakhstan" No. 3 (48) in 2017.

In the modern world, the rapid development of digital technologies brings undeniable advantages in the field of information and communications, but at the same time, it is accompanied by wide opportunities for intrusion into private life, which, in turn, require the adoption of effective measures to ensure its reliable protection.

The article reveals the nature and content of the right to privacy as a fundamental human right in international and national law.

The author of the article studied universal international and regional acts, as well as advisory documents in the field of human rights protection in the context of digitalization. Separately considered the mandate of the UN Special Rapporteur on the right to privacy. Also, national political and strategic documents, and legal acts in the field of ensuring the protection of human rights in the light of the development of digital technologies, taking into account the international obligations of Kazakhstan, were studied.

In his article M.Zh. Kulikpaeva raises important issues of ensuring the protection of human rights in the context of the development of digital technologies, in particular: the weak level of cyber security of official and unofficial sites that work with personal data; lack of qualified specialists in the field of information security of the country; lack of a system of constant monitoring, accounting and control over the development of digital technologies, etc.

Affected in the article by M.Zh. Kulikpaeva, the problems of international legal support for the protection of human rights in the light of the development of digital technologies are relevant to this day, and require further improvement of national legislation, taking into account the international obligations of the Republic of Kazakhstan.
