ON INNOVATIONS IN ORGANIZATION OF THE INSTITUTE OF ACADEMIC LEGAL EXPERTISE IN THE REPUBLIC OF KAZAKHSTAN

The article is devoted to topical issues of the improvement of the institute of academic legal expertise in the Republic of Kazakhstan. Currently, academic legal expertise is an important tool for identifying problems and contradictions that were in the development of regulatory legal acts, thereby contributing to the improvement of their quality. As it is known, a new model of academic legal expertise has begun to operate in Kazakhstan, which began to be implemented in Kazakhstan since the adoption of the Law of the Republic of Kazakhstan «On amendments and supplements to certain legislative acts of the Republic of Kazakhstan on the improvement of the rulemaking» of March 12, 2021 No. 15-VII, and the Resolution of the Government of the Republic of Kazakhstan «Certain issues of organization and conduct of scientific expertise» of June 8, 2021 No. 386, developed in compliance with the provisions of this Law, which regulates the legal and organizational basis for the introduction of a new model of academic legal expertise. The author reveals the main organizational and legal aspects of the new model of academic legal expertise, which conceptually changes the process and organization of academic legal expertise. Thus, the article discusses such major characteristics of the new model of academic legal expertise as the creation of a special pool of academic experts (in the form of a Register of academic experts), the organization of the selection of academic experts from the Register of Experts, the unification of deadlines for academic legal expertise, the sequence of legal expertise and academic legal expertise of international treaties and their projects, the general algorithm of academic legal expertise, and aspects of the responsibility of academic experts, etc.
