PROBLEMS OF COUNTERACTION TO CRIMES COMMITTED WITH THE APPLICATION OF INFORMATION SYSTEMS AND THE WAYS TO SOLVE SUCH ISSUES

The article describes issues of countering crimes with the use of information systems. The analysis of legal statistics of the last three years show negative trends, which are confirmed by scholar’s views of jurisprudence. Moreover, statistics show the existence of the problems in the organization of countering cybercrime. The lack of special knowledge in the field of new computer technologies and law enforcement and judicial authorities do not allow to properly qualify and investigate crimes of this category. In this regard, the authors proposed the creation of specialized units in the law enforcement agencies of Kazakhstan, which will include cybercrime investigation departments, as well as operational-technical departments that carry out detection and information support 24/7. The reason for the low efficiency is the lack of a sufficient number of scientifically grounded and tested tactics and methods, recommendations and explanations for investigating crimes in the field of information technology, and generalized judicial practice on cybercrime. Along with the problems mentioned above, the authors highlighted difficulties in the international cooperation of the competent authorities in obtaining information and evidence on the territory of foreign states. Importance issues are interaction with the official representatives of social networks: YouTube, Facebook, Instagram, Whatsapp, Twitter, etc. for information about users. As a positive experience, the adoption of the European Convention on Computer Crimes, which allows you to quickly receive information from foreign countries, is noted. The authors proposed its ratification with reservation on articles contrary to national law. The article describes the positive experience of individual foreign countries in the organization of countering cybercrime. According to the results of the study, the authors formulated conclusions of an organizational and legal nature to increase the effectiveness of law enforcement.
