RIGHTS OF CONSUMERS TO OBTAIN NECESSARY AND RELIABLE INFORMATION

This article deals with the problem of consumer protection when purchasing goods. Every member of society, young or old, is a consumer of goods, works, or other services, and often faces violations of consumer rights, so every citizen must be aware of his rights as a consumer and be able to protect himself. This issue is relevant. Thus, the President of Kazakhstan, in his Address to the people of Kazakhstan, announced on October 5, 2018, noted that the health of the nation is the main priority of the state.
The article notes that the protection of consumer rights is mainly carried out when the contract of sale and various contracts that mediate the obligations to provide services. The article points out the obligations of the seller and the buyer, which is that the seller must give complete, necessary and reliable information about the product, and the buyer must inspect the product when it is purchased. The author believes that the provision of necessary, reliable, timely and accessible information is the main responsibility of the seller.
In addition, the rights of the consumer when buying low-quality goods, its consequences are described. Suggestions are made for introducing norms into the Law of the Republic of Kazakhstan “On Protection of Consumer Rights”, into the Code of Administrative Offenses of the Republic of Kazakhstan, concerning the seller’s responsibility for providing complete and necessary information about a product.
The article also provides for the creation of a special body called the Committee for the Control of the Quality and Safety of Goods and Services.
For competent provision of information about the product and competent protection of their consumer rights, the author proposes to develop a Regulation on the ethics of the seller and the buyer.
The article discusses foreign practice, in particular, experience in consumer protection in France.
