Abstract

 In January, 2017 employees of the department civil, civil procedure law and enforcement proceedings of the SI «Institute of Legislation of the Republic of Kazakhstan» conducted analysis of legal regulation and the use of integrated circuits topologies in the Republic of Kazakhstan.

The analysis showed the presence of a number of said object of intellectual property and the need for a conceptual review of the provisions of the problematic issues in the legal regulation of legal acts in this area in order to ensure the necessary conditions for the introduction and spread of the use of integrated circuits topologies.

It should be noted that the institution of the topologies of integrated circuits is one of the least understood sections of intellectual property rights and in general has been studied by only a few lawyer-scientists such as T.E. Kaudyrov, L. Podshibihin, M.A. Kolomeitseva, V.A. Korneev, M.I. Nikitin and others.

Thus, the question of the concept of integrated circuits topologies, their legal protection, relations with other objects of intellectual property, in our opinion, are little studied and require further study and analysis.

The Messages of the President of the Republic of Kazakhstan N.A. Nazarbayev to people of Kazakhstan indicated the creation of knowledge-based economy as one of the priorities of Kazakhstan's joining the 30 most developed countries of the world, which includes increasing the capacity of Kazakhstan science, including through improvement of the legislation on intellectual property protection, support research and innovation, as well as the commercialization of scientific developments.

Also, as one of the main directions of Kazakhstan's successful integration into the world economy in the country the formation of favorable conditions for the production of goods with protected intellectual property rights and trademark is indicated.

In this context, the aim of this study is to analyze the national and international legislation in the field of integrated circuit topologies and to develop appropriate proposals for improving the legislation in this area.
