ON SOME ISSUES OF LEGISLATIVE TECHNIQUE AND LANGUAGE

Abstract

In the article the author touches upon the problems related to legislative techniques and language. It makes an analysis of the circumstances brought to negative results when the terms are incorrectly used in the legislation. The article focuses on problems related to the translation of normative legal acts into the Kazakh language.

The author reminds that with the observance of legislative techniques, special attention should be paid to the rules and principles of the logical creation of normative legal acts, to the legislative language and applied language norms when writing it. The author brings to the general discussion his scientific conclusions about the methods used for clarity and clarity of the legal norm when creating a system of normative legal acts. He proves that translators in the legislative process, as well as its participants, must adhere to the stable principles of the exact description in the text of the generally accepted understanding of the objective need.

Specific examples prove that in order for the normative act to be extremely clear, it must necessarily be clearly developed, have a logical system that should not allow ambiguous interpretation.

The author indicates negative results if you do not pay attention to the available dictionaries when translating the normative act into the Kazakh language. Despite the published dictionaries in Russian, especially important for a legal interpreter, he shares critical conclusions about shortcomings committed in cases of not paying attention to the explanatory dictionary of the Kazakh literary language. He warns that the absence of clear and understandable meaning in the Kazakh language in the text of the law leads to improper execution of the law, and that such irresponsibility should not be allowed.
