CONCEPT AND CHARACTER FEATURES OF THE FUTURES CONTRACT

This article is prepared on the basis of the results of the analytical report, devoted to the analysis of problems and prospects of the futures contract in the derivatives market, on which a researcher of the Civil, Civil Procedure Legislation and Executive Procedure Department of the Institute of Legislation of the Republic of Kazakhstan in 2017 worked. Investigation of derivative securities, derivative financial instruments and a direct futures contract was made by Belov V.A., Didenko A.G., Kandybka A.I., Moroz S.P., Nurgazina A.M., Safonova T.F., Salikhova A.R., Uldanova D.R. and other researchers.
At the same time, the consideration of the above issues has recently become particularly important. In particular, in paragraph 2.5 of the Concept of Legal Policy of the Republic of Kazakhstan for the period from 2010 to 2020 it was noted that the legal regulation of the securities market will be aimed at further development and increase of competitiveness of the national securities market, creation of favorable conditions for its participants, And a range of financial instruments, the development of the investor base and ensuring the protection of the interests of investors. At the same time, the increased uncertainty of the country's economy, the inability to mobilize capital only through standard financial instruments, determined the need to use financial innovations, such as derivatives. Taking into account the fact that Kazakhstan does not have a solid legislative framework for the regulation of the derivatives market, as well as a significant demand for them, this research is topical.
In this connection, the goal is to analyze the concept and specific features of a futures contract. To achieve this goal, dialectics, metaphysics, deduction, analysis, comparison, synthesis, generalization and formal-legal method are used.
The obtained research results in this article can be used in legislative work to improve the legislation of the Republic of Kazakhstan on the market for derivative financial instruments, as well as in scientific research in the field of legal regulation of financial markets.
