NATIONAL SOCIETY OF THE RED CRESCENT OF THE REPUBLIC OF KAZAKHSTAN: HISTORY, FEATURES AND PROBLEMS OF LEGAL STATUS

Abstract

 The authors of the article set themselves the following tasks: to reveal the origins of the emergence of the National Red Crescent Society of the Republic of Kazakhstan, to determine the peculiarities of its legal status, and also to analyze some legal problems related to the status of the National Society and adversely affect the possibilities of its fruitful functioning. To successfully solve these problems, the historical method and methods of structural-functional and system analysis were applied.

The article considers the historical roots of the National Red Crescent Society of the Republic of Kazakhstan, whose predecessor is the Red Cross Society of the Kazakh SSR. The authors state that the legal status of the NKCP RK has a complex, complex character, in which the norms of international law and the legislation of Kazakhstan are combined. They come to the conclusion that a specific feature of the current legal status of the National Red Crescent Society of the Republic of Kazakhstan is the presence of serious legal flaws. Because of these shortcomings, the large block of norms of the current legislation on non-commercial and public organizations can not be fully disseminated to the Company. Ultimately, this leads to the fact that Kazakhstan is in the position of a state that does not fulfill its international obligations under the Geneva Conventions and other international legal instruments. In turn, this fact creates a failure to fulfill one of the main tasks set in the Kazakhstan-2050 Strategy, namely, the task of intensifying international cooperation in the humanitarian sphere and supporting all progressive international initiatives. The authors see the way out of this situation in the adoption of a separate legislative act on the National Red Crescent Society of the Republic of Kazakhstan.

Conclusions, to which the authors of the article came, have a certain degree of scientific novelty, since they are voiced for the first time in the domestic legal science. At the same time, these conclusions have not only theoretical, but also practical significance for the further improvement of the current legislation of Kazakhstan and the successful implementation of the goals of the Kazakhstan-2050 Strategy.
