DEVELOPMENT OF ADMINISTRATIVE LAW AND ADMINISTRATIVE LEGISLATION OF THE REPUBLIC OF KAZAKHSTAN SINCE THE INDEPENDENCE

Abstract

The article describes the issues of the development of administrative law and administrative legislation in Kazakhstan since independence with the chronological and subject review of the regulatory acts, problems and outlooks of legislation improvement. The one of the thesis is the modern administrative law is not only for public administration but also provides for the administrative law instruments of protection from the illegal actions of government authorities (among many other issues). The author demonstrates the difficulties of the subject and system of the modern administrative law as well as shows the main regulatory acts adopted in Kazakhstan in respect of various parts of administrative law since 1991. The issue of new view regarding traditional administrative law institutions (like administrative liability) is raised in the article. The author also indicates the future acts which are worthy of notice: administrative procedures, administrative proceedings, executive bodies. The appearance of some laws, as law on administrative procedures or administrative proceedings, will testify to the fundamental changes in Kazakhstani administrative law and legislation. These changes are dealing with the new approaches in the relations between the public administration and individuals based not only on subordination but also on the mutual respect and equal protection in case of violations of both sides. The article also demonstrates that the fundamental rethink in respect to administrative law and administrative legislation reforms require significant efforts of administrative law scholars.
