IMPROVING ADVOCACY IN THE REPUBLIC OF KAZAKHSTAN

Abstract

This article has been prepared based on the analytical report, dedicated to the analysis of issues of improving advocacy in the Republic of Kazakhstan, worked out by a leading researcher of the department of civil, procedural legislation and enforcement proceedings of the “Institute of Legislation of the Republic of Kazakhstan" State Institution in 2016. In general, advocacy issues were addressed and analyzed in papers of a number of domestic and foreign scientists.

However, advocacy improvement issues have recently gained particular importance under the conditions of implementation of five institutional reforms of N.A. Nazarbayev, President of the Republic of Kazakhstan.

In this regard, the article has set a goal to elaborate recommendations for further improvement of the legal profession in Kazakhstan in accordance with international principles of advocacy, taking into account a comparative and legal analysis of advocacy in the CIS and foreign countries. To achieve this goal, the dialectics, metaphysics, deduction, analysis, comparison, synthesis, generalization and legal-technical method are applied.

Attention is paid to the challenges of the Republic of Kazakhstan advocacy legislation, regarding: 1) the legal status of a lawyer; 2) the order of certification; 3) the professional level of lawyers; 4) the legal community; 5) the regulation of lawyers’ activities. Based on the analysis of these and other issues of legal regulation of advocacy, series of recommendations have been elaborated.

The outcomes of the research in this article may be used in the legislative work to improve advocacy in the Republic of Kazakhstan.
