CURRENT ISSUES OF IMPROVING LAW-MAKING AND LAW ENFORCEMENT IN THE SPHERE OF POPULATION MIGRATION

Abstract

Recently, the military, sanctions and economic events taking place in the world, the mass migration of people are alarming and attract the attention of many states. At the same time, the growth in demand for scientific research aimed at studying the migration of the population, illegal migration, is a natural phenomenon. In addition, the term for the implementation of the Concept of the Migration Policy of the Republic of Kazakhstan for 2017-2021 has expired and the concept of the migration policy for 2022-2026 is currently being developed. When developing a new concept, a prerequisite is to take into account the scientific foundations. This article examines topical issues of consideration of civil cases on applications for the expulsion of a foreigner or stateless person from the Republic of Kazakhstan for violation of the legislation of the Republic of Kazakhstan, consideration of cases in administrative courts on violations by a foreigner or stateless person of the legislation of the Republic of Kazakhstan in the field of population migration, as well as topical issues of application of Article 394 of the Criminal Code of the Republic of Kazakhstan “Organization of illegal migration” are considered, recommendations are given to reduce the number of criminal offenses in the field of migration of the population and regulate illegal migration.
