ISSUES OF IMPROVING LEGISLATION ON POLITICAL PARTIES AND ELECTIONS IN ORDER TO ENSURE PARTICIPATION OF PERSONS WITH DISABILITIES IN THE SOCIO-POLITICAL LIFE OF THE COUNTRY

The development of civil society institutions is important for the further democratization of Kazakhstan. Political parties play an important role in this process.
At present, the issues of improving legislation on political parties, in terms of ensuring the necessary representation of various groups of the population in public authorities, politics, and their political participation, have not been studied enough, and this primarily concerns persons with disabilities.
Based on the analysis of national legislation and international documents, the article proposes legislative measures aimed at providing the access of persons with disabilities to active participation in the socio-political life of the country.
It is proposed to amend the Constitutional Law of the Republic of Kazakhstan «On Elections in the Republic of Kazakhstan» in order to make it mandatory to comply with the quota, not only at the stage of registration of party lists, but also at the stage of distribution of mandates. It is also proposed to provide that the authorized body in the field of public protection determine the procedure for ensuring an accessible environment as a necessary condition for the participation of persons with disabilities in elections.
It is being recommended in the Law of the Republic of Kazakhstan «On Political Parties» that a political party, when approving the lists of candidates for deputies of maslikhats, must include persons with disabilities, for thirty percent of the total number of candidates.
It is stipulated to provide in the Law of the Republic of Kazakhstan «On the Social Protection of Persons with Disabilities» а principle that ensures the accessibility and equal rights of persons with disabilities, along with other citizen to participate in elections and the activities of political parties. It is also suggested to define the definition of «accessible environment», the explanation of which is based on the Convention on the Rights of Persons with Disabilities ratified by Kazakhstan.
