THE RULE OF LAW AND ORDER BEING THE MOST IMPORTANT LEGAL FACTOR OF THE DEVELOPMENT OF A NATIONAL STATEHOOD IN CURRENT REALITY

Abstract

In the paper, the institute of statehood is considered in relation to the law and order, which are the pillars for the formation and development of national statehood. Despite there are numerous works published recently on this topic, the issue of strict observance and ensuring the relationship of national statehood with law and order is currently becoming particularly relevant and crucial, especially in the context of the life of the society, which we define today as "Zhana Kazakhstan". In modern conditions, compliance with legal rules by all parties involved in legal relations becomes the basis for establishing order, if these rules comply with legal ones. The entire mechanism of state governance, as well as every element of it, are aimed today at continuous improvement as a vital means of survival. The criticality of forming an effective mechanism for implementing the principles of legitimacy is caused by the increasing demands of people to strengthen the rule of law and order, protection from the consequences of criminal offenses. However, as practice shows, in reality, the development and publication of legal statutes cannot yet guarantee compliance of the rules with real social relations, the protection of human rights and freedoms, and the law. In this regard, in the paper, the institutions of the rule of law and order are considered as complementary bases in the system of implementing the functions of the mechanism of state power. The relevance of the conducted research and its practical value is determined by the fact that the paper summarizes the possible reasons for the decline in the rule of law and order, provides recommendations for improving the process of statehood formation in the state, and reviews the governmental measures planned to implement this goal.
