EXTRAJUDICIAL SETTLEMENT OF DISPUTES IN KAZAKHSTAN: THEORY AND PRACTICE PROBLEMS

Abstract

The article investigates some of the theoretical and practical problems of court settlement of disputes in the Republic of Kazakhstan. Particular attention is paid to such institutions of private procedural law (ADR) as mediation and arbitration proceedings (arbitration). In order to further the development of institutions amicable settlement of disputes in Kazakhstan the author proposes a number of concrete proposals to improve the existing legislation, and also grounds the remarks and suggestions on the draft Law of RK "On amendments and additions to some legislative acts of the Republic of Kazakhstan on questions of perfection of activity of arbitration and court of arbitration".
