THE TRANSFER OF THE KAZAKHSTANI PENAL SYSTEM TO THE CIVILIAN DEPARTMENT AS A LEGAL EXPERIMENT

Abstract

The authors of the article touch upon such an aspect as the reform of the law enforcement system in the state, law enforcement agencies are available in any state, regardless of the form of government, such departments exist and existed in Kazakhstan before independence.

In this paper, an attempt is made to analyze the work of the penal enforcement system during its transfer from the Ministry of Internal Affairs to the Ministry of Justice in the period from early 2002 to It was the next wave of reforms of the law enforcement unit. The authors draw attention to the fact that the return of the prison system to the bosom of the Ministry of Internal Affairs (Ministry of Internal Affairs) was carried out without explaining any reasons, but after the brief opinion of the then head of the department. The work focused on the ten-year period of executive system in the civilian department . Its role is comprehended, estimates and evaluations from the standpoint of independent experts, foreign experience are taken into account and its vision of further functioning of the prison system was proposed, based on the norms and standards of international penitentiary law in the affected sphere.
