THE ISSUE OF QUALITY OF LAWMAKING

Abstract

Any industry has its own structure, the development process, the novelty. If a philology science,especially the language industry is considered, there are alwaysnew ideas, statements as well as problems.

The article is devoted to the quality, the development of normative legal acts in the state language, the formation of terminological stockof the national legislation. Under the terms of the national legislation refers to terms used in the legislation. As one of directions of the realization of these objectives the legislative process is the principal tool of a formation of the national legislation.

With independence, achieving the uniformity of terms and words was paid close attention, while highlighting the importance of translation.The quality of the national legislation is closely linked to the development and the quality of the prosperity of the Kazakh language. Article 7 of the Constitution of the Republic of Kazakhstan dated August 30, 1995 states that «in state organizations and local self-government organizationsthe Russian languageis officially used on a par with the Kazakh language», thus marked by the question of authenticity of Russian and Kazakh languages.

The article focuses on the application of terms in the law, the translation problem, peculiarities of legal technique in the text of the law in the Kazakh and Russian languages, the prerequisite for the development of laws in the Kazakh language. The uniformity of terms and words on when drafting laws and international treaties, especially the correct translation of terms borrowed from foreign languages. Examples of gaps and errors in the law and international treatieswere also presented.
