REGULATORY SUPPORT OF THE FUNCTIONING OF THE INSTITUTE OF SELF-REGULATION IN THE REPUBLIC OF KAZAKHSTAN

In the context of the development of economic relations, the use of self-regulation mechanisms in some areas of entrepreneurial and professional activity becomes relevant. The institutionalization of self-regulation in the Republic of Kazakhstan has necessitated the consolidation of regulatory provisions in relevant legislative acts. Considering that the phenomenon of self-regulation is a relative innovation for the national legal system, the issues of its legislative regulation deserve attention.
In this study, legal norms indicating the first attempts to introduce a regulatory justification for the relations that existed in practice on self-regulation of auditing activities, in the field of the securities market, construction and the activities of bailiffs, have been identified. Further analysis of legal norms revealed an orderly formed since 2015 regulatory system in this area. General provisions regarding self-regulation are provided for by the Basic Law of the Republic of Kazakhstan «On Self-Regulation» and laws containing norms generally accepted for all organizations. Special rules for individual self-regulating organizations, such as chambers of legal consultants, appraisers, associations of actuaries, organizations of brokers or dealers, are embedded in industry legislation. According to the results of the study, it was found that legal regulation in the Republic of Kazakhstan provides for a system of general and special regulation in the field of self-regulation, depending on the specifics of the types of activities.
General scientific methods of cognition were used in the work, the formal legal method was used to study normative legal acts. The results of the study will be useful in further analysis of the qualitative content of the current legal norms in this area, as well as in studying the mechanism of self-regulation in general.
