ON THE HARMONIZATION OF NATIONAL LEGISLATION ON TRADE UNIONS WITH THE RULES OF ILO CONVENTION NO. 87 ON MEMBERSHIP OF TRADE UNION IN ASSOCIATIONS

The article analyzes the issues of integration of the legislation of the Republic of Kazakhstan on trade unions, exclusion of mandatory membership (Association) in associations at the levels of social partnership by the International Labour Organization Convention No. 87 «Оn Freedom of Association and protection of the right to join trade unions»[1]. The author has made a comparative analysis of the experience of trade Union confederations and international federations, the result was the conclusion about their purposes, goals and objectives, and differences related to historical peculiarities of development of movement of trade unions in a particular country. It is noted that in most foreign countries with a long history of development of the trade union movement, several large associations operate. Moreover, to solve common problems and pursue a common policy at the national level, to resolve disputes between unions, most unions are associated in a federation (confederation). Along with them are autonomous trade unions that are not members of any of the major federations (confederations). The activity of Kazakhstan's trade unions after legislative recognition, the right to join a trade Union, possible strategies and opportunities are evaluated. The main problems of preserving and attracting new members of trade Union activity at the present stage are identified and ways of solving them are suggested. The author concludes that after the introduction of legislation on the exclusion of mandatory membership in trade unions, the activity of trade unions allows a critical but constructive look at the interaction of the trade Union with the outside world in which it has to function.
