Abstract

In the present article, the authors conducted a study to establish the reasonableness of calculating the cost of forensic examinations conducted by the Center of judicial expertise of Ministry of Justice of the Republic of Kazakhstan. The Rules and Methods for determining the cost of conducting a forensic examination in forensic examination bodies, as well as the prices of forensic services, forensic medical examinations, research, forensic narcological, forensic psychiatric examinations provided at the expense of budgetary funds by the example of the Nur-Sultan branch were analyzed. During the preparation, general scientific and special methods were used: labor costs and charges related to the salary of the forensic expert, the cost of chemicals and consumables for expert research, discrepancy overhead (related) costs. In addition, foreign experience in determining prices for forensic examinations (United States of America, Russian Federation, Federal Republic of Germany) was studied. In conclusion, the authors made calculations and formulated a conclusion about the possible overestimation of the cost of forensic examinations by more than 98 million. tenge for the following reasons: overestimation of the cost of 1 minute of working time, which led to the incorrect determination of the cost of forensic examinations, remuneration of experts exceeded the cost of work performed, incorrect establishment of standards, as well as uneven distribution of load between experts. Application of the maximum rates of expenses of chemical reagents and expendables can lead to overestimation of cost of examinations. Also formulated recommendations on the revision and adoption of a new methodology.
