Abstract

The article discusses the issues of legal support of local self-government at the present stage in connection with the adoption of the Concept for the development of local self-government in the Republic of Kazakhstan until 2025. The analysis of the main provisions of the Concept aimed at solving key problems hindering the development of local self-government in the country is carried out. Based on the study of the opinions of scientists on these problems, a critical understanding of the norms of the current legislation regulating the issues of local self-government in Kazakhstan, a set of measures is proposed to improve the legal support for the development of this institution.

In particular, noting the inevitability of emerging contradictions in the legislation, instead of the Law on local self-government, it was proposed to develop a draft of a new Law "On local government and self-government in the Republic of Kazakhstan."There are substantiated necessity of determining the dual status of maslikhats, akimats and akims, a clear delineation of the functions of local government and local self-government not only at the rural, but also at the district, city level, the introduction of double responsibility of local representative and executive bodies vertically (to higher authorities) and horizontally (in front of the population).Particular attention is paid to strengthening the independence of rural akims as heads of local self-government, giving the right to nominate candidates for akims to public associations, meetings or gatherings of citizens, depriving the district akim of the right to nominate candidates for rural akims.It is proposed to gradually extend direct elections of akims by the population to akims of all levels.The issues of introducing a mixed system of forming maslikhats are also being raised, electing half of the deputies according to the majority system from among independent candidates, reducing the barrier barrier for parties to participate in the distribution of mandates of maslikhat deputies elected on party lists, strengthening the control powers of maslikhats, etc.
