Abstract

Every citizen has a constitutional right to housing, which consists in its inviolability from illegal deprivation and illegal entry. In addition, housing is an object of property rights and as any property right in its composition has rights. The right to use housing consists of the ability to extract its useful natural properties from the property at its own discretion, as well as to benefit from it.

The right of ownership of housing allows you to extract useful properties in different ways, either to live in it, or to rent out housing. Rental housing as a way to make a profit is divided into long-term and short-term. At the same time, not only detached houses are rented, but also apartments and rooms in apartment buildings. As a rule, short-term rentals in apartment buildings have problems associated with the fact that tenants grossly violate the rights of citizens living in the neighborhood. In addition, the issue of temporary registration of citizens is acute due to the increased frequency of terrorist acts.

This issue was repeatedly raised at the highest level, which resulted in the adoption of amendments to the Decree of the government of the Republic of Kazakhstan. However, the situation and the resulting problems were not resolved definitively. Half-hearted measures did not fundamentally solve the problem of hourly and daily rental of housing. Until now, tenants continue to violate the peace and quiet of citizens living in the neighborhood.

All the problems that arise with renting housing are in the legal culture of citizens, which is reduced to the abuse of their rights by landlords and violation of the law by tenants. The article scientifically substantiates the inadmissibility of abuse in the exercise of rights when renting housing for short-term rent. All the circumstances of the settlement of this problem are analyzed and proposals for its resolution are presented.
