ON STRENGTHENING THE ADMINISTRATIVE AND CRIMINAL LIABILITY FOR TRAFFIC OFFENSES

Abstract

. With the continuous rise of the rate of development of road transport and growing traffic, it is difficult to ensure order and traffic safety on the roads and streets of cities and other settlements.

The questions of safety of movement of motor transport constantly consist not only within the competence of individual agencies and organizations and the whole society in our country.

Offences, encroaching upon the safe operation of vehicles, first isolated in the domestic legislation in a separate Chapter in the Criminal code of 16 July 1997. This is because at the present stage of development of society, that is, with the increasing number of vehicles, greatly increased the prevalence and danger of crimes against safe for people and society transportation performance.

The Union of these crimes in a separate Chapter due to their infringement on the single generic object, what are the public relations providing traffic safety and operation of railway, water, automobile, air and pipeline transport.

The authors of the article were considered issues of law enforcement for the commission of the accident by a person in a state of alcoholic, narcotic, and (or) toxic intoxication, resulting in grave consequences, as well as proposed measures to strengthen the administrative and criminal liability for traffic offenses.

The authors believe that additional measures to tighten penalties for these offenses will reduce the number of drunk drivers on the roads that will consequently lead to a reduction in traffic accidents.

First and foremost, you should tighten administrative responsibility of persons, allowing himself to create real threat of life of people by driving vehicle while intoxicated.
