LOGIC AND LANGUAGE OF LOW

Abstract

 Іn this article  Esenkul Safuani leads his opinion about  the role of  logic and language of the law for the proper execution and clarifications of legislation. Systematically arguing  that  logic and style of the law directly affecting on his tongue draws attention to the fact that  legislative language is significantly different from the language that we use in every day. Despite the fact that still say that the law should be written in plain language understandable to people of lawmaking fact that the language of the law is not interpreted with artistic language of reason to think about those who are engaged  in translation  of the law. In this regard, the author gives examples of laws based on the arguments of the scientific literature.

Though prove that the particular differences between the language of  legislation and in plain language is necessary  to pay attention to the fact that in some cases common everyday language that is used  in everyday life in the home is shaped, its cannot fully and accurately  convey the meaning of the normative definitions. On this basis, of this reasoned opinions of the author once again proves that it is necessary as it should pay attention to the values of legal terms.

The author, regarding to the scientific literature, divides the special terms that used in the legislative activities on: the terms that are rarely used in everyday language, is not very familiar to the general public; terms understandable in plain language, but their legal meaning is quite different. The opinion shows examples of laws in the field of business and criminal law.

Citing an example of what some of the terms are used differently in the laws, again he wants to convey, it is impossible to avoid such gaps.
