Abstract

This scientific article was implemented within the framework of the fundamental and applied scientific research concerning the proper differentiation and application of the norms of the new Criminal Code of the Republic of Kazakhstan adopted on July 3, 2014.

Considering the modernization of legislative regulation and the rule of criminal law in the light of the development of legal institutions in Kazakhstan society today, the experts emphasize the need for further improvement of the foundations of this sphere.

The author of this article focuses on the improvement of the criminal justice regulation of the crime component. Guided by the provisions of the Constitution of the Republic of Kazakhstan, protection of human and citizen's rights and freedoms is one of the main factors in the effective legal policy.

The effective solution of the issues highlighted in this article focuses on the creation of favorable conditions for law-makers through further improvement of criminal legislation, the correct definition of the crime scene, the objective side of the crime component, the correct misstatement of crimes committed in unfinished criminal and criminal offenses.
