TO THE ISSUE OF JURIDICAL MEDIATION INTRODUCTION UNDER THE PROJECT OF CIVIL PROCEDURE CODE OF THE REPUBLIC OF KAZAKHSTAN

Abstract

This article is dedicated to mediation concept, as an alternative way to resolve conflicts. Legal regulation of this concept in the project of code of legal procedure arouses some apprehension. In this regard, this article examines the foreign experience of mediation regulation as well as analyses the exciting regulations of the local legislation. In the judgment of the author, basic theoretical studies of mediation must come before introducing changes in the legislation. This is the only way for mediation to become really effective way of conflicts resolution.
