ANALYSIS OF LEGISLATION OF THE REPUBLIC OF KAZAKHSTAN REGULATING THE ISSUES OF THE USE OF AIR SPACE AND ACTIVITY OF AVIATION

Abstract

The authors considered some issues of regulating the use of airspace and aviation activities in the Republic of Kazakhstan within the framework of legal monitoring in this article.

The relevance of the topic under consideration is due to the fact that today the development of aviation in Kazakhstan is envisaged as one of the most important directions of state policy, including taking into account the need to bring the RK legislation in line with international standards, as well as providing a unified approach to regulating this industry in the territory of  Eurasian Economic Union.

In connection with the above the authors studied the norms of the legislation of the Republic of Kazakhstan in the field of airspace use and aviation activities (in particular in the field of certification, requirements for aviation personnel, flight rules, safety management, aircraft maintenance, airworthiness standards, meteorological and radio engineering support and etc.), International Standards and Recommended Practices of  ICAO (ICAO standards), as well as the legislation of the EEU member states in this field.

During the analysis some unnecessary administrative barriers to entry into the aviation market, gaps, inconsistencies and collisions of various types were identified, on the basis of which relevant conclusions and recommendations were developed to improve the legislation of the Republic of Kazakhstan, including taking into account the best foreign practice and the currently existing trends in the harmonization of the legislation of the member states of the EEU.
