INTERNATIONAL LEGAL ASPECTS OF REGULATION IN THE FIELD OF NUCLEAR ENERGY

Abstract

The world community recognizes the presence of a huge potential danger that nuclear power industry is fraught with, including emergencies on atomic industries and atomic infrastructure facilities, the possibility of using nuclear engineering for criminal purposes. In this respect, an immediate refusal to use nuclear engineering can create incomparably greater harm to both humans and ecology. In the context of the transition of many countries of the world to decarbonization politics, a special role is given to the nuclear power industry. The question of what political and legal prerequisites for expanding the scope of legal regulation in the sphere of nuclear power industry exist today, determines the subject of this research. With the help of the method of political and legal analysis used in the work, the research is serves to answer the question of what direction modern international initiatives in the sphere of legal regulation in the area of atomic energy are developing, as well as give an idea of what level and in what form will be carried out legislative regulation in the above sphere. The research gives reason to believe that in the immediate outlook, the expansion of the sphere of legal regulation in the area of atomic energy at the EU level, the CIS will be carried out mainly through acts of soft law, as well as bilateral agreements relating to a more technical aspects of the functioning of atomic infrastructure objects. In a practical aspect, this research is attractive to lawyers practicing in the sphere of international public law, international private law, as well as an energy law.
