CONDUCTING SCIENTIFIC LINGUISTIC EXPERTISE AS THE MOST IMPORTANT STAGE OF THE RULE-MAKING PROCESS

Abstract

Rulemaking in the Kazakh language is an urgent problem of this process in the Republic of Kazakhstan. It is well known that the predominance of standard-setting practice in Russian in the conditions of bilingualism in the Republic of Kazakhstan is due to various objective reasons. Nevertheless, there is also experience in this area of rulemaking in the state language. Therefore, increasing its volume and quality is a big problem facing both state bodies and officials, as well as society.

In the diverse rule-making practice of state bodies, the process of issuing subordinate regulatory legal acts with simple and duplicative, standard and simple lexical composition, with fewer legal consequences, is mainly only departmental in nature. Therefore, its legal and other consequences may not affect the interests of the majority. And legal acts, such as the Code, the constitutional law, the consolidated law and the ordinary law, must be impeccable both in legal and linguistic relations, since they affect the interests of the state and society as a whole. Such requirements are established in the current legislation. Therefore, a special place in ensuring the legal and linguistic quality of legislative acts, in particular in ensuring the authenticity of their texts in Kazakh and Russian, is occupied by scientific linguistic expertise. Some aspects of the state and prospects of scientific linguistic expertise are considered as the object of the article.
