THE NEED TO IMPROVE STANDARDS OF ILO CONVENTIONS AND THE KAZAKHSTAN LABOR LAW

Abstract

In this scientific article the author proposes to analyze the rules of ILO conventions to which the Republic of Kazakhstan, in order to be able on the basis of clear rules of the international legal instruments to improve similar labor law regulations of the Republic of Kazakhstan. In one researching article it can not be subjected to a detailed analysis of all the several tens of ILO Conventions, which entered the Kazakh legal field. Therefore, this article has been tasked to analyze only several ILO conventions among those to which the Kazakh state joined. The object of scientific and legal analysis are the Convention on Equal treatment and equal opportunities for men and women workers: workers with family responsibilities, adopted in Geneva on the 67-th session of the ILO General Conference on 23 June 1981, the Protection of wages Convention, adopted in Geneva on 32-th session of the General conference of the ILO 1 July 1949, the ILO Convention on the Establishment of procedures for setting the minimum wage by 16 June 1928. The analysis of these conventions has been made in order to improve the rules of the conventions themselves. The author points the shortcomings in the standards of the ILO conventions and offers his approaches, formulates proposals in order to improve the content of these conventions. The scientific article says that the Republic of Kazakhstan as the official member country of the conventions may periodically through the Administrative Office of the ILO make proposals for improving the text of these and other conventions and seek to improve them.
